過去的二十年間，美國的法學院錄取的男女學生人數(shù)基本相當，而2016年，錄取的女生人數(shù)第一次超過男生。然而女性庭辯律師仍舊是少數(shù)派，首席律師隊伍里就更少見到女性的身影了。斯坦福大學法學教授Deborah Rhode在2001年曾發(fā)表標志性報告，揭露法庭上的性別歧視。她說，女律師面對“雙重標準和雙重限制”，一方面她們要避免被看成“太軟弱”或“太尖銳”，既不能“太有攻擊性”，也不能“沒有攻擊性”。男性律師常常會使用一些伎倆來喚醒法官的性別歧視，例如庭審剛開始就提起抗議，說對方的女律師曾因在法庭上哭泣演戲而出名，要求此次案件法官杜絕她的這種“風格”。雖然此事純屬構(gòu)陷，法官最后也不會同意抗議，但男律師的目的已經(jīng)達到，他成功地讓法官對女律師留下了“操縱情緒”“擅長演戲”的印象。女律師也常常因為穿著而不得不小心翼翼，不能穿得太女性化，法官會覺得你在不當利用性別魅力，但又不能讓人覺得你是個男人婆。做個女人難，做個女律師尤其難。
